If the outcome of the main proceedings is that the claimant does not have a claim, the arrest will have been wrongful and the claimant will be liable for damages arising out of the arrest. The liability in case of a wrongful arrest is given and the debtor will only have to prove that he has suffered damages as a result of the arrest and the amount of the damages. These damages can consist of the costs to keep the ship running and quay dues, but also indirect damages such has loss of hire.
